Supplemental Terms of Use
These Supplemental Terms of Use (the “Terms”) apply if you participate in the MetaMask Rewards program (the “Program”) offered by Consensys Software, Inc. (“Consensys”). The Terms are incorporated into and form part of the Consensys Terms of Use posted at https://consensys.io/terms-of-use (the “ToU”). THE TOU CONTAIN A BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS WHICH MAY SIGNIFICANTLY IMPACT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. IF YOU DO NOT AGREE TO ALL OF THESE TERMS IN THEIR ENTIRETY, YOU MAY NOT PARTICIPATE IN METAMASK REWARDS.
To the extent that there is a conflict between the Terms and the ToU, the Terms take precedence.
Overview
The Program is an opt-in loyalty program that allows MetaMask users to earn MetaMask Points, progress through a series of loyalty tiers (or “Levels”) and unlock Rewards. The Program runs on a seasonal basis.
Eligibility
To be eligible to participate in the Program, you must be a MetaMask user at the time of participation and agree to these Terms and the ToU.
You can not participate in the Program if you reside in the United Kingdom.
MetaMask Points
You can earn MetaMask Points:
from your use of the MetaMask offering, which may include your present and past usage; and
by referring users. Please note the limitations set out below in the section entitled ‘Referrals - limitations’.
From time to time, Consensys may make available alternative methods to earn MetaMask Points. If this is the case, we will inform you.
You earn MetaMask Points for each Season (see ‘Term’ below) that you are opted-in to the Program. A defined portion of MetaMask Points earned in a current Season may carry-over to the following Season. You can view the MetaMask Points that you have earned by navigating to the 'Rewards' section of the MetaMask mobile app. The number of MetaMask Points which you earn in a Season will determine the Rewards and Level for which you are eligible.
Referrals - limitations
You can invite others (‘referees’) to participate in the Program as a referrer. Each user who is signed up is provided with a referral link and an unique code. You earn a defined portion of MetaMask Points based on the activity of your referees for the Season in which the referee opts-in to the Program and for the Season which immediately follows. If a referee does not opt-in to the Program using your referral link or code, you do not earn MetaMask Points.
The referees must be located in a jurisdiction in which MetaMask is currently offered. You represent that, to the extent any consent is necessary under applicable laws or regulations, you have consent to send texts, emails, or other communications regarding the Program, including sending your referral link or code to those you refer. Using paid advertising involving the words MetaMask or Consensys or other related words to promote your referral link or code is prohibited. Every time you share your referral link or code, you must tell the referee that you earn an incentive if they sign up and engage with the Program.
Failure to comply with these requirements may result in Consensys voiding any referrals and MetaMask revoking or declining to issue any MetaMask Points or Rewards.
Rewards
You may use the MetaMask Points earned to redeem Rewards that are offered by Consensys. Rewards may vary periodically and depending on the region where you reside. You can redeem rewards by navigating to the 'Rewards' section of the MetaMask mobile app.
Depending on the Reward being offered, it may be redeemed either: (i) during the Season in which the MetaMask Points are earned; or (ii) at the end of that Season. You may redeem Rewards for up to a period of 1 year following the end of the relevant Season.
Please note that for some Rewards, for example the provision of physical merchandise or digital subscriptions, you may need to engage with a third party provider to redeem that Reward. We will inform you if this is the case.
Term
The Program is opt-in and you will remain opted-in until you opt-out. You can opt-out at any time. Each Season lasts for a period of 3 months, after which a new Season commences.
Disqualification and Program Management
Consensys may disqualify you from participating, remove MetaMask Points, downgrade your Level, deem you ineligible for Rewards or take other action as deemed necessary at Consensys’ own discretion if you violate the Terms, attempt to defraud Consensys or engage in behaviour designed to exploit the Program. Consensys reserves the right to review your engagement with the Program at any time and without notice to determine your compliance with the Terms. Consensys may revoke or decline to issue MetaMask Points or Rewards for any reason at any time.
Miscellaneous
Consensys reserves the right to cancel, suspend, or modify the Program and these Terms in part or in its entirety at any time without notice. Similar offers may run at the same time; qualification for Rewards does not constitute qualification for any other offer. Consensys is not responsible and/or liable if any e-mail, Reward, or offer-related materials or correspondence are not delivered for any reason. Your MetaMask Points or Rewards cannot be transferred or assigned.
Privacy
By agreeing to these Terms and engaging with the Program, you acknowledge that your personal information may be processed in accordance with the MetaMask Rewards Supplemental Privacy Notice and the Consensys Global Privacy Notice.
MetaMask Rewards Supplemental Privacy Notice
This Supplemental Privacy Notice applies to you only if you participate in the MetaMask Rewards offering. Consensys Software, Inc. is the data controller with regard to the provision of the offering. This Supplemental Privacy Notice sets out important information about the collection and processing of personal information that may occur when you engage with the offering. This Supplemental Privacy Notice is incorporated into and forms part of the Consensys Global Privacy Notice. Defined terms used in the Supplemental Privacy Notice have the same meaning as those defined in the Global Privacy Notice.
1. Personal Information We Collect
a. Rewards related information - information related to your engagement with the MetaMask Rewards offering, including your MetaMask Points, Levels and the details of Rewards claimed.
b. Usage information - your use of the MetaMask offering to determine your eligibility to earn MetaMask Points and Rewards. This may include your use of the swap, bridge, perps, card, on ramp and staking features and may involve current and past usage of the MetaMask offering.
c. Referral related information - when you refer a user or if you are referred, we process information to determine the eligibility for a reward associated with that referral.
d. Other information - we process additional information where necessary for the purposes of your engagement in the rewards program. This may include wallet and externally owned account (EOA) related information, to the extent that you link EOAs for the purposes of earning MetaMask Points or Rewards.
Please note that for some Rewards, for example the provision of physical merchandise or digital subscriptions, you may need to share additional personal information with a third party provider to redeem that reward. Consensys does not process personal information in this context. The collection and processing of personal information is completed independently from Consensys and pursuant to the terms and privacy notice (if any) of that third party.
From time to time, we may receive information from third-party partners about your activity in the Web3 ecosystem for the purposes of providing you with additional MetaMask Points. We will provide you with additional information where this is the case.
2. How We Use the Personal Information We Collect?
We only process personal information as necessary to provide the MetaMask Rewards offering, which includes providing you with support services, where relevant. If you are in a region where a legal basis is required for the purposes of processing personal information, we rely on the performance of the contract between you and Consensys Software, Inc. for these purposes.
Depending on the region, countries or states based on where you reside, you may have certain rights in relation to your personal information. For further information, please see section 6 of our Global Privacy Notice, entitled ‘Your Rights’.
To the extent that there is a conflict between the information contained in this Supplemental Notice and the Global Privacy Notice, this Supplemental Notice takes precedence.
